Here at ROMARG we believe in transparency and we care about your privacy. We strictly collect the information necessary to provide the services you have ordered, and we keep it safe.

GENERAL INFORMATION


This Policy explains our privacy practices for ROMARG.ro or ROMARG.com (the "Site"). This Privacy Policy applies to all services provided by ROMARG SRL (hereinafter referred to as "ROMARG", "we", "us" or "our"). This Privacy Policy explains why and how we collect and use personal information about our customers.

1. INFORMATION COLLECTION


When you access and browse the Site we collect the following information about you:

Information submitted by you


Contact date - we receive and save any information transmitted by completing an order. Order forms collect information about you that includes: name and surname, CNP or NIF, postal address (domicile / residence / mailing address), telephone number, email address, location data (IP).

Information we receive by using our services


Automatic Information - when you visit our website we collect information, which may constitute personal data. This information includes IP address, referral url, last page visited, browser type, operating system. We may record the date and time of access as well as the number of clicks made on our site.

Traffic measurement tools - We use traffic measurement services provided by third parties (Google Analytics) to collect information about the use of the Site, such as visits, pages visited. We also track the popularity of published content. Traffic measurement tools use specific tracking techniques (for example: cookies) to recognize your device and analyze information about you. It collects the following information: which pages you visited and how long you spent on those pages, your IP address, what operating system you are using, what browser you are using and which website you visited before coming to our website.

1. Information logs - When you visit the Site, access content provided by us, use our services, use our chat application, ask us questions, request technical assistance in connection with the services provided, send us email or participate in contests or fill out satisfaction forms on our website we automatically collect and store a series of information in log files. This information includes the IP address, web address, website visited before, web address of exit, browser used, operating system, date and time, type of request transmitted and any errors received from the Site or services.
2. Other information - We also receive and store any information that you transmit on our Site, through our Chat, email, telephone or any other communication with our team or in connection with the provision of contracted services. Each time you contact us, we will record the ticket, chat or telephone call to ensure that we have accurate information so that we can still provide the contracted services and to support the actions taken by our team in the event of a complaint about the response received from us.


2. HOW WE USE THE INFORMATION



The information you provide:


We collect, store and use the information you provide for the following reasons:

1. Contact information - to contact you about your orders, the status of our services, changes in the functionality of our services and the Site. Also, when you have expressly consented to receive such information, we send you information about our new services/special offers or periodic notifications. We use email, telephone or text messaging (SMS) to inform you about possible problems with your hosting accounts, interruptions in the functionality of our services, or updates or improvements to our services.
2. Payments and financial information - this information is required together with the contract information in order to open a customer account, to finalize a new order or to extend an existing contract, to start a new contract, to issue an invoice and to fulfill our legal and fiscal obligations.

Information about your use of our services


We collect, store and use the information we receive as a result of your use of our services for the following reasons:

1. Automatic information - to identify problems with our servers, to administer the Site and our services. This information cannot identify an individual except to prevent fraud or abuse of our Site or our systems.
2. Statistical tools - to improve our services and our Website.
3. Log information - to identify possible problems, administer our Site.
4. Other information - to administer your account and orders, to have accurate and relevant information in case of a dispute/claim and to identify concrete elements that can help us to improve the services provided.


3. PURPOSE OF DATA PROCESSING


When you access or use our Services, we must collect, use your information in accordance with this Policy. We respect privacy and adhere to several fundamental principles when processing personal data:

  • We will collect the minimum amount of personal information that is necessary to deliver the contracted Services
  • We provide full transparency about how we will use your information in order to comply with our legal obligations respecting your privacy
  • We ensure that we use the information only for the purpose for which you have given your consent

Personal data are processed, in accordance with this Policy, for:

1. Contract - based on your order for the provision of services and products from ROMARG's commercial offer (e.g. registration and extension of web domains, hosting services, SSL certificates, virtual servers, dedicated servers).
2. Legal obligations - reporting to the National Agency for Fiscal Administration and other state institutions (at their express request) for the fulfillment of activities related to the authorities' controls, such as ANAF, ANPC, ANSPDCP, IPJ, Prosecutor's Office, etc.
3. Legitimate interest - necessary for purposes legitimate to our legitimate interest, such as:

  • to offer our customers the products or services ordered;
  • to identify and prevent illegal activities, fraud;
  • to improve network and information systems security;
  • to better understand how visitors interact with our site;
  • identify the effectiveness of promotional and marketing campaigns;
4. Consent - we rely on your consent to use your personal data to deliver the products or services you have ordered, to send you marketing information (periodic emails, newsletters, maximum 1 per month and promotional offers) by email. You can withdraw your consent to receive marketing information at any time by updating the settings in your customer account.


4. RECIPIENTS OF PERSONAL DATA


Your personal data may be transmitted to the following categories of recipients:

1. Person concerned or its representatives;
2. Organizations national or international (e.g. RoTLD, Tucows Inc., Eurid, etc.)
3. Authorities public Romanian (e.g.: ANAF, National Office for the Prevention and Combating of Money Laundering, Prosecutor's Offices, IGP, etc) and foreign (e.g.: European Commission, tax authorities, courts, etc).

Personal data may be transferred to entities in the European Union, EEA or outside the EU only for the purpose for which the data subject has placed the order on the ROMARG platform. The personal data transmitted will be those declared by the data subject and non-excessive in relation to the purpose for which it is necessary to send it to a third party.

Regarding the personal data transferred to Tucows Inc. (Canada), having the capacity of controller, there is DECISION no. 173/12.12.2006 of the National Authority for the Supervision of Personal Data Processing (on the recognition of an adequate level of protection of personal data ensured by the Canadian Act of April 13, 2000).


5. SECURITY MEASURES


We use Secure Sockets Layer (SSL) to encrypt the information you fill out on the Site in order to protect the security and integrity of the information to and from the Site. When storing information, critical and sensitive data we ensure that it is encrypted.

We have physical, electronic/software measures and procedures in place regarding the collection, storage, and disclosure of potentially personally-identifying and personally-identifying information. Our procedures, in some cases, require us to ask you for proof of your identity before providing you with information or responding to your requests.

To protect your account against unauthorized access, we have implemented session management and automatic expiration measures. As an additional security measure, we remind you to log out using the Log-out option when you are finished using your client account or computer and not to save passwords in your browser.

Although we are dedicated to data security, and we take the necessary measures to ensure a high level of security you should be aware that no data transmission over the Internet can be guaranteed to be secure. You should therefore be aware that we cannot guarantee the complete security of the personal data you transfer over the Internet to us.


6. RETENTION PERIOD


Keeping and processing of personal data is carried out for the duration of validity of the contracts concluded with ROMARG or the validity of the domains registered through the Site, plus 10 years from the termination of the contractual relationship or expiration of the domains, if by an applicable legal provision is not necessary to keep for a longer period.


7. YOUR RIGHTS


As a data subject, you have the following Rights with regard to your Personal Data:

1. right of access to data (Article 15 of the Regulation);
2. the right to rectification of the data (Article 16 of the Regulation), following the identification of the applicant;
3. the right to erasure of the data, a request which will be analyzed from the point of view of the fulfillment of the express conditions of Article 17 of the Regulation and the purpose of the collection;
4. the right to data restriction, a request that will be analyzed in terms of compliance with the express conditions of Article 18 of the Regulation;
5. the right to data portability (Article 20 of the Regulation);
6. right to opposition (Article 21 of the Regulation);
7. the right not to be subject to a decision based solely on automated processing, including profiling (according to Art. 22 of the Regulation);
8. the right to address the National Authority for the Supervision of Personal Data Processing and Justice.

By accessing the Account Details section of the Customer Area, you can access, modify, correct information associated with your account. To the extent that you need additional assistance or wish to exercise these rights, you may contact us using the information set forth in this Policy in the "Questions and Contacts" section.


8. AGE LIMIT


In accordance with the ROMARG Terms and Conditions, we do not provide services or collect information from persons under the age of 18. To the extent that you have evidence that a minor (under 18 years of age) has purchased services or provided us with their personal information, please contact us using the information set forth in this Policy in the "Questions and Contacts" section.


9. CHANGES TO THE PRIVACY POLICY


We reserve the right to change our Privacy Policy at any time. If we decide to change this Policy, we will post those updates here or in any other place we deem appropriate so that you are informed about the information we collect.
If we make material changes to this Privacy Policy, we will notify you in this section, by email or through the Site at least 15 days before such changes take effect.

If you make a request concerning the exercise of your data protection rights, we will respond to your request within the one-month period provided for by the Regulation.

Your consent to the processing operations is expressed once you submit an online order in accordance with the provisions of Law no. 667/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data.
